Mediation is a voluntary process where an independent mediator helps both willing parties discuss their issues, identify concerns, and explore possible solutions. 

The mediator does not make decisions or take sides. Instead, they facilitate a fair and impartial discussion so each person has the opportunity to express their perspective.

You can choose to be in the same room, or different rooms. Our Maroochydore office is set up to ensure you feel safe and comfortable during the mediation.

A guide through the mediation process

Understanding what to expect can make the mediation process feel far less daunting. While every situation is different, most mediation matters follow a structured process designed to encourage productive discussion, and ultimately, resolution.

Practice Director Elizabeth Fairon says “Mediators can come from different backgrounds and skillsets. You may be referred to a mediator by a trusted source (such as your lawyer), however, it’s still worth looking at the mediator’s background and qualifications. Some may be more skilled in financial discussions or family law discussions etc. Look around, look at their websites and understand their qualifications to make an informed decision.”

Step 1: Initial Consultation

The process begins with a confidential consultation where we discuss your situation and determine whether mediation is appropriate. During this meeting (which can be in our Maroochydore office, over the phone or zoom), we explain how mediation works, what issues may be discussed, and how the process can support resolution.

Step 2: Preparation for Mediation

Before mediation sessions take place, both parties are given the opportunity to prepare. This may include gathering relevant information, identifying key issues, and considering possible solutions. Preparation ensures that discussions remain focused and constructive.

Step 3: Mediation Sessions

During the mediation session, the mediator guides the conversation between both parties. The aim is to create a respectful and balanced environment where each person can express their views and concerns. The mediator helps clarify misunderstandings, explore options, and encourage practical problem solving.

Step 4: Negotiating Agreements

As discussions progress, the focus shifts to identifying solutions that work for both parties. Agreements reached during mediation may relate to parenting arrangements, financial matters, property issues, or communication strategies.

Step 5: Documenting the Outcome

If an agreement is reached, the key outcomes can be documented so both parties clearly understand the arrangements moving forward. Where appropriate, these agreements may later be formalised through legal processes.
