When you are dealing with a separation, estate planning, or an estate dispute, one of the most important things to understand is this:

Many people assume the only option is to “go to court” – but in reality, there are a number of different pathways available. Each has its place, and each works best in different situations.

Court Proceedings

Court is sometimes necessary – particularly where there are urgent issues, safety concerns, or a complete breakdown in communication.

In this process:

  • Each party is represented by a lawyer
  • Evidence is prepared and presented
  • A judge ultimately makes the decisions

Things to consider:

  • It can take time – often many months, sometimes longer
  • It can be costly
  • The outcome is decided by someone else
  • The process can feel formal and, at times, adversarial

Court has an important role. But it is not the only way forward.

Lawyer-Led Negotiation

In this approach:

  • Each person has their own lawyer
  • Lawyers communicate (by email, letter or phone) to try to reach agreement
  • You may not be directly involved in every conversation

Things to consider:

  • It can be effective where both parties are open to resolution
  • It may still become positional or drawn out over time
  • Communication can sometimes feel indirect or frustrating

For some clients, this works well. For others, it can feel like progress is slow or uncertain.

Mediation

In this process:

  • The mediator does not give legal advice
  • The mediator is not the decision maker
  • You may or may not have your lawyer present
  • The focus is on helping you reach agreement together

Things to consider:

  • It can be a helpful way to move discussions forward
  • It often happens in a single session or a small number of sessions
  • You may need legal advice separately, before or after mediation

Mediation can be a valuable step – either on its own, or as part of a broader process.

Collaborative Practice

Collaborative Practice brings together the strengths of legal advice, guided conversations, and professional support – in a process designed to help you reach agreement without going to court.

In this process:

  • You each have your own collaboratively trained lawyer
  • Everyone agrees from the outset to focus on resolution, not litigation
  • Discussions take place in structured, face-to-face meetings
  • Information is shared openly and transparently
  • Other professionals (such as financial advisers or counsellors) can be involved where helpful

Things to consider:

  • You remain actively involved in discussions and decisions
  • The process is private and tailored to your situation
  • It supports both practical outcomes and the relationships around them
  • If the process doesn’t work, the collaborative lawyers step aside before any court process begins
